Across all of its operations, the CHUM Foundation is committed to safeguarding the confidentiality of information related to strategic, philanthropic, administrative and other activities, including, but not limited to, personal information.
As a fundraising organization for the Centre hospitalier de l’Université de Montréal (CHUM), we securely collect, use and disclose personal information on a daily basis in order to deliver our services and carry out our work to provide information, solicit various types of contributions and encourage participation in events, webinars, raffles and lotteries. Your privacy is important to us, and so is being transparent about what kind of information we hold and how we obtain and use this information. We handle all information, especially personal information, in accordance with the highest ethical standards, such as Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and Law 25 modernizing Quebec’s Act respecting the protection of personal information in the private sector.
The purpose of this Privacy Policy (the “Policy”) is to help you understand our practices for collecting, using, disclosing and retaining personal information. By providing us with personal information (whether via our website, on an email sign up form for an event, in person or over the phone), you agree to your personal information being handled as set out in this Policy, and you authorize the CHUM Foundation, its third parties and its service providers to handle your personal information for the purposes set out below.
The Policy does not apply to, and the CHUM Foundation is not responsible for, any third-party websites that may be accessible through links on this website. If you follow a link to a third-party website, that third party will have its own privacy policies, which you should review before submitting any personal information.
What personal information do we collect?
- Professional and/or personal contact information, such as first and last name, address, email address, date of birth and phone number
- Biographical information such as job title, employer name, professional and/or personal history, photograph and video or audio content
- Marketing information and communication preferences, as well as related information such as dietary preferences and survey comments and answers
- Contribution history and participation in organization events, billing and financial information such as billing address, bank account information and payment information
- Information about services provided
- Employment history, networks, community involvement, professional memberships and family information
- Recruitment information, such as your resumé, education and employment history, details of professional memberships and other information relevant to potential recruitment by the CHUM Foundation
- Website usage and other technical information, such as details of visits to our website, your interaction with our online advertising and content, and information collected through cookies and other tracking technologies
- Information provided to us by or on behalf of our clients, partners and donors or generated by us in the course of providing our services, which may, where relevant, include sensitive categories of personal information (clothing size information for golf tournament, allergy information, etc.)
- Information such as community investment and donation policies, contributions, organizations donated to and their causes (if applicable), donor recognition received, the decision-making process, the individuals involved in the organization and the decision-making process
- Any other personal information provided. Please note that if you provide personal information to us about other people (such as your customers, directors, officers, shareholders or beneficial owners), you must ensure that you have given those individuals appropriate notice that you are providing their information to us and have obtained their consent to that disclosure
- Where applicable, records of consent given to us (date, time, means of consent), in circumstances where such consent is needed for the processing of personal information
How do we collect personal information?
- When you sign up for events, webinars, training and newsletters
- When you register for fundraisers and raffles
- When you make any kind of donation to our organization
- When you sign up to volunteer for our organization
- During the course of providing services to you
- When we interview you to gather testimonials or during the recruitment process
- When you apply for a seat on our board of directors, our campaign cabinet and/or any other CHUM Foundation committee
How do we use personal information?
We may use personal information in the following ways, either with your consent or, where applicable, in accordance
with applicable law, such as:
- To provide our services, conduct our business and administer and perform our services, including to carry out our obligations arising from any agreements entered into
- To facilitate use of our website, ensure content is relevant and ensure that content on our website is presented in the most effective manner for you and your device
- For marketing and business development purposes – to provide details of new services, updates about our organization and sector and invitations to seminars and events, if an individual has chosen to receive these
- For research and development purposes (including from a security perspective) – for analysis in order to better understand our clients’ service and marketing requirements and to better understand our organization and develop our services and offerings
- For recruitment purposes – to enable us to process applications for employment and to assess your suitability for any position for which you may apply at the CHUM Foundation
- To fulfill our legal, regulatory or risk management obligations
- To fight against fraud and/or perform other background checks, including those that may be required by applicable law or regulation and/or best practice at any given time (if false or inaccurate information is provided or fraud is identified or suspected, details may be passed on to fraud prevention agencies and may be recorded by them or by the CHUM Foundation). We may also rely on substantial public interest (prevention or detection of crime) or legal claims as the basis for processing sensitive categories of personal information
- To enforce our legal rights, to comply with our legal or regulatory reporting obligations and/or to protect the rights of third parties
- For accounting purposes, to send payments or invoices – to recover any payments due to us and, where necessary, enforce such recovery through the engagement of debt collection agencies or other legal action (including court proceedings)
- To reorganize or make changes to our organization – in the event that we undergo a reorganization (for example, if we merge, combine or divest a part of our organization), we may need to transfer some or all of your personal information to the relevant third party (or its advisors), as part of either a due diligence process or a transfer of information to that reorganized entity or third party for the same purposes as set out in this Policy or for the purpose of analyzing any proposed reorganization. If this occurs, we will do everything in our power to protect and secure all personal information in our possession.
With whom do we share personal information?
The CHUM Foundation is a non-profit organization. Any personal information that we collect may be shared with and processed by any entity within the CHUM Foundation’s network. No information will be shared or sold for commercial purposes.
We may share personal information with certain third parties, such as:
- Our volunteers, in order to help them provide services and solicit financial and other contributions
- Third-party service providers and/or partners who provide human resources recruitment, donation solicitation, data analytics, website, application development, hosting, maintenance, timing and other services to us. These third parties may have access to or process personal information to provide their services. We limit the information provided to these service providers to only what is reasonably necessary for them to carry out their work, and our contracts with them require them to maintain the confidentiality of such information
- Law enforcement and governmental entities when required by law. For greater clarity, we may disclose personal information or other information if required to do so by law, including tax law, or in the good faith belief that that such action is necessary to comply with applicable laws, in response to a court order or government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies
- An acquirer, successor or assignee as part of any merger, acquisition, debt financing, sale of assets or similar transaction, as well as in the event of insolvency, bankruptcy or receivership in which personal information is transferred to one or more third parties as one of our business assets
We will only use personal information to fulfill the primary purpose and applicable legitimate purpose it was collected for, or for a purpose compatible with that primary purpose.
Our organization uses services provided by third-party websites such as Google and Facebook to promote our content and offerings.
When you visit our website, these third parties may use cookies, web beacons and other similar technologies on your hard drive to collect or receive information about your browsing activity on our website and elsewhere on the internet. What rights do I have over my personal information?
- Access: the right to ask whether we are processing information and, if we are, request access to personal information. Subject to applicable law and, where applicable, payment of a possible fee, this enables the individual to receive a copy of the personal information we hold and certain other kinds of information about that individual
- Accuracy: the right to ensure that the personal information in our possession is accurate
- Correction: the right to request that any incomplete or inaccurate personal information we hold be corrected
- De-indexing: the right to request that we cease disseminating the individual’s personal information or de index any hyperlink attached to their name that provides access to information if the dissemination of the information causes injury to the individual or contravenes the law or a court order (the right to erasure or right to be forgotten)
- Anonymization: the right to have us anonymize your personal information instead of destroying it so that we can use that information, but only for serious and legitimate purposes (for example, to keep information required for a potential audit)
- The right to be informed if any decision made about them is based exclusively on the automated processing of information
- The right to be informed if we use identification, location tracking or profiling technology and the means by which the identification, location tracking and profiling features of the technology can be activated
Finally, you can also file a complaint with a data protection supervisory authority, in particular in the country/province/state where you normally reside (in Quebec, the Commission d’accès à l’information), where we are based or where an alleged infringement of data protection law has taken place.
